General Privacy

MID is firmly committed to user privacy. The MID Privacy Policy applies to visitors to our Website, SMS notification users, and users of our services, who may share information with us via our Website, email, regular mail services, telephone or other communication methods. Additionally, this Privacy Policy covers information received from third party providers. The purpose of this policy is to help you understand what information we may collect from users of our Website and services that may be used to personally identify you, and how we intend to use, share, and protect such information.

Any information that can be used to identify individual customers (“Private Information”) is collected only with user permission. This document discloses types of information collected, how information is collected, and addresses the end-use of collected information.

By accessing or using our Website or services, communicating with us, and providing your information, you are bound by and consent to our collection, use, storage and processing of information in accordance with this Privacy Policy.

Information that cannot be used to identify individual users

Collected information in this category includes your internet service provider address, your browser type and plug-ins, pages visited and time of day you logged on. De-identified and aggregated consumer information is not considered Private Information. “De-identified or aggregate consumer information” means information that relates to an individual or group, from which individual consumer identities have been removed, and is not linked or reasonably linkable to any consumer or household, including via a device. De-identified or aggregate consumer information may be analyzed by MID or by third parties that MID has engaged for such purposes to determine general audience interests and Website design requirements.

 

Cookies Policy

A “cookie” is an element of data that a website can send to your browser and store your preferences when you link to that website. MID uses cookies to better serve you when you return to our Website. Cookies are not a computer program and have no ability to read or access data residing on your device. Cookies cannot instruct your device to perform any function. By assigning a unique data element to each visitor, our Website is able to recognize repeat users, track usage patterns, and store user preferences and trends. Cookies do not extract Personally Identifiable Information about you beyond what you provide while using the Website, just the device that you use to visit the Website. MID does not combine the general information collected via cookies with other Personal Information to tell us who you are.

First party cookies are cookies set by the website you are visiting. Persistent cookies are cookies that remain on your device for the period of time specified in the cookie. Persistent cookies are activated each time that you visit the website that created that particular cookie. To help serve you better, we use persistent, first-party cookies to receive and store certain types of information whenever you interact with our Website through your computer or mobile device. This information helps us identify return visitors to enhance your user experience, to tailor our Website to your preferences and track usage to understand what content is most useful to our Website’s visitors.

Information that can be used to identify individual users (Personal Information)

Personal Information includes information from your use of our Website and SMS notifications that may be used to identify you. Personal Information also includes information you provide to us about yourself or your household in order to use our services. The Personal Information we collect from you will depend on your use of, and interaction with, our Website, SMS notifications, mobile application, and services. Such information may include: information you provide to us (such as contact, address, identification, and billing information); information related to your use of our services (such as electric usage); information collected when you use our Website (such as information about your operating system, IP address or geolocation data).

Personal Information about MID customers will never be stored on our web server. Generally, Personal Information collected from your use of our Website will only be used for MID purposes and will be treated with the same security precautions as data gathered by other means (i.e., telephone, written forms, mail-in information, etc.).

Application forms or requests for specific information may request a user to submit their name, phone number, fax number, street address, e-mail address, account number, or other information that can be used to identify that individual.

E-mail addresses and phone numbers will be used to respond to specific customer requests, for account-related communications and to provide information about the District services.

How Personal Information that MID collects is used

Generally, MID does not use your Personal Information for purposes beyond what is needed to provide services to you or for other reasons as specified by law.

For example, we may use the information collected to:

  • Deliver and maintain our service(s) such as providing customer service
  • Establish and maintain your account records
  • Provide account-related services and information
  • Help you with service and technical support issues or questions related to our Website or your account
  • Manage and protect our networks, services, employees and users
  • Detect, resist and prevent fraud or other malicious or deceptive activities, or ensure the physical safety of a person
  • Research, develop and market new products and services
  • Analyze usage of our Website and provide functionality to our Website.
  • Determine your eligibility for new products and services
  • Authenticate you
  • Contact you with business offers
  • Help train employees and support resources and systems to better serve you

MID does not use your Personal Information for purposes outside those stated in this Privacy Policy without your consent.

Retention and sharing of information collected

MID retains records containing Personal Information for as long as they are needed for service delivery, legal, tax, audit, investigative and/or security purposes. To the extent that records are subject to the MID’s Records Retention Schedule, retention will generally exceed 24 months and will vary based on the type of record.

As a general rule, your Personal Information will not be given to outside entities, such as other public agencies, contractors, direct marketers, or other non-MID public or private sector organizations except when we have your permission. However, MID may share such information with outside entities under special circumstances, such as when we believe in good faith that the law requires it, to enforce MID’s rights arising from our agreements with you, or in the good faith belief that such action is necessary to (i) protect and defend against harm the rights, safety and property of MID or (ii) act in an emergency to protect the personal safety of our customers or the public.

Additionally, as a public agency, MID is subject to the California Public Records Act (Gov. Code, § 7920.000), which may require the disclosure of non-exempt public records. However, public records will be redacted to remove exempt customer Personal Information to the full extent allowed by law, including your name, your social security number, your home address, your telephone number, credit history information, and your service usage data.

 

SMS Messaging

SMS data is only applicable when you opt-in to specific programs or when interacting directly with MID representatives for specific services such as new construction or irrigation water orders.  Your SMS opt-in consent is never shared with third parties.  SMS data is used to send transactional or account related messages, respond to inquiries or support requests, and to analyze message delivery and engagement to improve services. The number of messages you receive will vary based on how you use the services and whether you generate more SMS messages from MID such as by sending a help request.

You can opt out of SMS messages at any time by replying “STOP” to any message or contacting MID customer service to update your preferences. After opting out, you will no longer receive text messages from us unless you opt in again.

 

Your right to know about MID’s use of your Personal Information

Under California law, you have the right to access and know what Personal Information MID collects about you. You may:

  • Review Your Information. You can email us at customerservice@mid.org or call (209) 526-7337. or contact MID customer service by phone to set up an appointment to review the Personal Information we have about you. You can only review records that contain your Personal Information, and you’ll have to provide proper identification to do so.
  • Correct or Delete Your Information. You have the right to request that MID deletes the Personal Information it has about you, subject to certain limitations. MID cannot delete Personal Information where the information and other activities needed to maintain an ongoing business relationship or perform a contract with you, to maintain information security, or to exercise legal rights and to comply with other laws, including, without limitation, applicable state records retention laws. MID will work with you to correct inaccurate information in our records if necessary.
  • Request and Receive Your Information. You may request, to the extent technically feasible, any Personal Information collected and/or shared by MID in the preceding twelve (12) months by emailing your request to customerservice@mid.org or calling (209) 526-7337.
  • Opt-Out. MID does not share customer Personal Information except under special circumstances. Such exceptions include if the sale or sharing is necessary for MID to comply with its legal obligations, exercise legal claims or rights, defend legal claims, and other circumstances. To the extent allowable, you may opt out of the sharing of your Personal Information.
  • MID will not discriminate or retaliate against you if you exercise any of the above options pertaining to your control over your Personal Information.

 

Children’s Privacy Notice for Parents

MID’s Website and SMS notifications are not intended for children under 18 years of age. No one under age 18 may hold an account or provide any Personal Information to our Website. MID does not knowingly collect Personal Information from anyone under the age of 18. If you believe that a child under 18 years of age has provided us with Personal Information, please contact us at customerservice@mid.org or calling (209) 526-7337 and we will work to delete that information as is reasonably practicable.

Any information inadvertently collected from a child under the age of 18 years is subject to the same security, guidelines, and other requirements of this Policy. Security Statement

MID has created this security statement in order to demonstrate our firm commitment to security. MID uses technical, administrative and physical safeguards to help protect against unauthorized access to, use or disclosure of information we collect or store. In addition, MID employees are trained in the importance of privacy and information security, and in this policy’s restrictions on the access, use and disclosure of customer information. MID’s policies prohibit employees with whom we share this information from using sensitive information unless they are authorized to do so and have a business need.
