Modesto Irrigation District Terms of Use for Online Services

This website is operated by Modesto Irrigation District (MID).

PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THIS WEBSITE.  BY USING THIS WEBSITE, YOU WILL BE ACCEPTING THESE TERMS OF USE.  IF YOU DO NOT AGREE WITH THESE TERMS OF USE, DO NOT USE THIS WEBSITE.  MID MAY MODIFY THESE TERMS AND CONDITIONS AT ANY TIME.  MODIFICATIONS BECOME EFFECTIVE IMMEDIATELY UPON POSTING.  PLEASE CHECK THESE TERMS PERIODICALLY FOR CHANGES.

Description of Service

MID customers can enroll in and access the following services in the MID Online area of the MID website:

View and Pay Bills.  You can view and pay MID bills using MID Online service.  There are no additional fees charged by MID for using our MID Online service.  When you request to pay your MID bills online using MID Online, MID will debit your credit card.  To use MID Online, you must accept MID’S MID Online Terms of Use.

Other Services.  You may also use MID Online to analyze bills and view payment and usage history.

Payment Terms

Payment Due Date
Your bill becomes delinquent after 5:00 pm on the due date.  If you do not pay all charges by 5:00 pm on the due date, MID may shut off your electric service after giving you proper notice.  Payments made on-line will be posted to your MID account within two business days.  Business days are Monday through Friday, excluding holidays.

Late payment penalty
A late payment penalty of 1.5% or a minimum of $5.00 will be assessed on any unpaid balance after 5:00 pm on the due date.

Billing dispute procedure
If you believe your bill is wrong , please request an explanation by email or by calling MID at (209) 526-7337 within 5 days of receiving your bill and before the payment due date shown on your  bill.  After your call, if you still believe your bill is wrong, you may request an in-person hearing.  MID will not disconnect your electric service while an investigation of your bill is pending.

Terms of Use

User Account.  We reserve the right to accept or decline any application to open a user account and the right to terminate any user account.   The right to use the services of a user account on our website is limited to you as the enrolling party.  You agree to provide accurate and complete information when opening a user account.

Fraudulent Use.  You must safeguard your password to prevent unauthorized persons from accessing your account information, as you acknowledge that MID cannot verify the identity of persons using the service under your password.  If you allow others to access your online account information, you will be responsible for all actions that such person takes with respect to your account.  If you suspect that your account has been fraudulently used or otherwise compromised, please notify us immediately by sending us an email message. 

Copyright.  MID Online is an online information service with MID retaining copyrights to all text and graphic images.  Except as allowed in these Terms of Use, contents (text and graphics) may not be reproduced, modified, edited, distributed, republished, downloaded, or transmitted (in whole or in part) in any form or by any means, including but not limited to electronic, mechanical, photocopying, recording, or otherwise, without MID’s express permission. 

You may print copies of the information for your own personal use or store files on your own computer for your personal use only.

Trademarks.  Trademarks, logos, scripts, domain names, URLs and other identifiers (“Trademarks”) used and displayed on the MID website are registered and unregistered Trademarks of MID and others in the United States and other countries.  No display or use of such Trademarks may be made without the express prior written permission of MID or other Trademark owner.  You may not use meta tags or any other “hidden text” utilizing MID’s name or Trademarks without the express prior written permission of MID.

Third Party Sites.  Some of the links in this area allow you to leave the MID website.  These third party links are provided for convenience only.  MID is not responsible for the contents of any linked site and the presence of such links does not imply an endorsement or relationship between MID and any such third party. 

Third parties may not link to the MID website in such a way the pages of the website are displayed within a frame on a third-party website, or are otherwise displayed on a browser screen with advertising or other content not found on the MID website.

No user or third party is authorized to use any software, bots, spiders, or other information gathering devices or programming routines to monitor, copy or otherwise “mine” information from the MID website.

Indemnification.  You agree to indemnify, defend and hold MID, its directors, employees, agents shareholders, licensors, suppliers and any third party information providers for the MID service from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of these terms and conditions by you or users of your user account.

Warranties Disclaimed.  You expressly agree that your use of this website is at your sole risk.  MID does not make any express or implied warranties that the service will be uninterrupted, error free, free of computer viruses or will meet your requirements for quality, security or otherwise.

Limitation of Liability.  MID will not be responsible for any costs or damages arising either directly or indirectly from any transaction related to the MID Online service.  MID, its affiliates or subsidiaries, and their directors, employees, agents, successors, or assigns, will not be liable to you or any third party for any indirect, consequential, incidental, exemplary, special or punitive damages (including without limitation damages resulting from lost data, lost profits or costs of procurement of substitute product or service arising out of or in connection with the MID website or any of the services available on or through the MID website.

Governing Law.  This agreement shall be governed and construed in accordance with the laws of California.  If any provision of these Terms of Use is held to be unlawful, void or for any reason unenforceable, then that provision will be deemed severable and will not affect the validity and enforceability of the remaining provision.

Website Privacy Policy

MID is committed to ensuring that your privacy is protected.  Information provided by you by which you can be identified when using this website will only be used in accordance with this privacy policy.  MID may modify this privacy policy at any time.  Modifications become effective immediately upon posting.

Information Collected
If you register to access various services related to your account on the website, you may be asked to submit personal information such as your MID account number, name, address, phone number and email address.  You may also be asked to submit additional personal information or financial information in order to use certain services or perform transactions related to your customer account. 

How We Use Your Information
MID will not collect or maintain your private and personally identifiable information without your written consent (consent may be obtained electronically, such as by email).   Further, we will not sell, license or disclose your personal information to any third party without your consent, unless we are compelled to do so under the law or to comply with a court order.

In order to provide you with service offered on the website, or to complete transactions or requests initiated by you on the website, we may transfer you to outside service provided by third-party operators.  In such cases, we will have agreements with those third parties to maintain the confidentiality of your personal information and to use it only to help us serve you.  We do not provide your personal information to third parties for telemarketing, email or direct mail solicitation.

Other than as set forth herein, we will not disclose your personal information without your consent unless we reasonably believe the disclosure is essential to the ability of MID to provide services to you, to comply with the law, collect unpaid bills, obtain and provide credit reporting information or resolve customer disputes.

Security
Once you login to MID Online, any account information you enter or that is displayed in your browser window is secured using an industry standard security technology known as Secure Sockets Layer (“SSL”).  By using SSL, we attempt to safeguard the confidentiality of your personal and financial information.  Your browser must be capable of supporting SSL.  Please check with your browser manufacturer for details.
