Approved by unanimous vote

A resolution to reopen discussion of raising the irrigation water allocation sometime before the end of the 2008 irrigation season.  Earlier this year the Board set the 2008 base water allocation at 36 inches.

An agreement for legal services between Modesto Irrigation District and Timothy O’Laughlin, engaging O’Laughlin to serve as General Counsel on a contractual basis.

Staff reports

Water Report

Walt Ward, Assistant General Manager of Water Operations, reported that snow sensor data show accumulations of 106 percent of normal in the northern Sierra, 99 percent in the southern Sierra but only 87 percent in the central Sierra. The California Dept. of Water Resources forecasts 83 percent of normal April–July runoff in the Tuolumne River watershed and just 70 percent of normal for the entire water year. The latest predictions were revised downward due to extremely dry conditions during March. Water storage in Don Pedro Reservoir has now dropped slightly below the long-term average and is expected to trend lower. According to Ward, the reservoir is unlikely to fill this year. MID is running lots of water in the irrigation system due to high grower demand. Spring pulse flows for salmon are scheduled April 22 through May 22.

Staff Investigation of Claim

Two staff reports were presented regarding a claim filed by Mr. and Mrs. Bill Bunnell, Modesto.

Claims Procedures

Risk & Property Analyst Kim Griffin explained that claims procedures are set forth in the California Government Code. Each item listed on a claim is carefully reviewed to determine the nature and extent of the damage and whether the damage could have been caused by the incident in question. MID makes settlement offers for the cost of repair and/or replacement of items actually damaged as a result of the incident. Offers are based on fair market value of the items at the time when the damage occurred.

Investigation of Electrical Problems

Tom Kimball, Assistant General Manager, Transmission & Distribution, reported on MID’s investigation of electrical problems at the Bunnell home. The customers reported problems affecting their appliances since moving into their home in August 2006. Immediately after their first call to MID on August 25, 2007, an MID troubleshooter arrived on scene, isolated a problem and corrected it. Due to the unusual number and severity of problems, MID provided assistance beyond the level normally offered, visiting the home five more times between Sept. 2007 and March 2008. Test equipment was connected at the home on several occasions to monitor and record electrical voltage and current around the clock for seven-day periods.

Findings

The MID troubleshooter found and corrected a problem on the utility side of the electric meter. During all subsequent visits, MID tests showed voltage normal. No further problems were found with MID service or equipment. MID staff, working alongside the home builder’s electrician, found nine loose connections into the house at the customers’ breaker box.

Announcement following closed session

The MID Board of Directors, by majority vote, rejected the second amended claim of Mr. and Mrs. Bunnell.
